Welcome to ADU Profit. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Homeowner," or "Builder Partner") and ADU Profit (collectively, "we," "us," or "our") governing your access to and use of aduprofit.com, our interactive cost estimates, ROI calculations, and our contractor matching matching services. By accessing or using the site, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use the platform.
1. Description of Services & Marketplace Role
ADU Profit provides an interactive feasibility calculator to estimate construction costs, rental yields, and net cash flow potential for Accessory Dwelling Units (ADUs). Additionally, we act as a referral directory matching homeowners with third-party General Contractors (GCs) and Financing Lenders.
2. Feasibility Estimate & ROI Disclaimer
All mathematical calculations, construction costs, interest rates, down payments, local zoning compliance assumptions, and estimated monthly rental incomes generated by our tool represent ballpark estimates. They do not constitute formal construction bids, binding quotes, or financial guarantees.
Actual costs will vary depending on site topography, soil testing, utility utility upgrade fees (which often add $5,000 to $25,000), local city permit fees, plan check cycles, and final finish selections.
3. Homeowner Responsibility: Contractor Verification
We conduct initial vetting of general contractors (verifying active license status, general liability insurance, and workers' compensation coverage at the time of their onboarding). However:
- Homeowners are solely responsible for independently verifying a builder's license status directly with the local state licensing board (e.g., California Contractors State License Board - CSLB, Texas Department of Licensing and Regulation, etc.) before signing building contracts.
- We do not warrant, guarantee, or assume liability for the quality of workmanship, project timelines, materials, structural compliance, or conduct of any matched contractor.
- We are not a party to any contract signed between homeowners and builders, and we will not arbitrate or intervene in any project disputes or mechanic's lien issues.
4. Financing & RESPA Disclaimer
Lending matches are provided strictly as advertisements. In compliance with the Real Estate Settlement Procedures Act (RESPA), we do not charge lenders referral fees or commissions on loans closed. Lenders pay a flat advertising placement fee. Lenders are responsible for determining loan qualification, and we make no guarantees of credit approval.
5. Builder Partner Portal & Credit Wallet (B2B Terms)
If you register as a Contractor Partner on our platform:
- Pre-paid Wallet: Leads are distributed to all builders matching the targeting criteria in their Settings. Your wallet balance is automatically decremented by 1 credit (representing fair market advertising value) for each matching homeowner lead received.
- Non-Refundable Credits: Purchased lead credits are final, non-refundable, and have no cash value.
- Auto-Recharge: By enabling auto-recharge in your billing settings, you authorize ADU Profit to charge your stored credit card automatically when your wallet balance falls below the threshold you select.
- License Maintenance: You represent and warrant that you hold an active, valid general contractor license and required insurances. You must notify us immediately if your license is suspended, expired, or revoked.
6. Limitation of Liability
To the maximum extent permitted by applicable law, ADU Profit and its officers, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, construction delays, property damage, personal injury, structural defects, or business interruptions arising out of or in connection with your use of the website or services.
7. Governing Law & Binding Arbitration
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, the website, or the service shall be resolved through final and binding individual arbitration in Los Angeles, California, administered by JAMS. You waive your right to participate in class actions or class-wide arbitration.
