ADU Profit (collectively, "we," "us," or "our") operates the website aduprofit.com and associated tools, features, and lead-matching services. This Privacy Policy describes how we collect, use, share, and protect your personal information when you use our Homeowner ROI Calculator and Partner Portal, specifically tailored to comply with the federal Telephone Consumer Protection Act (TCPA), the Real Estate Settlement Procedures Act (RESPA), and state privacy acts in California (CCPA/CPRA), Texas (TDPSA), Florida (FDBR), Colorado (CPA), Washington (My Health My Data Act), and other jurisdictions where our services expand.

1. Information We Collect

To provide personalized ADU feasibility estimates and match you with local service partners, we collect the following categories of information:

  • Contact Information: Full name, email address, and phone number.
  • Property Data: Property street address, ZIP code, lot topography, and backyard access characteristics.
  • Project Preferences: Target square footage, bedrooms, bathrooms, project type (garage conversion vs. new build), estimated credit band, primary goal, and planned timeline.
  • Partner/Contractor Data: Business name, license credentials, target states and area codes, and pre-paid billing information.

2. Sharing Consent & Matchmaking Distribution

By filling out our estimation form, submitting your information, and checking the consent box, you are providing your explicit written instruction and authorization for us to share your lead configuration details and contact information with matched General Contractors and Financing Partners within our network.

This transfer of data is performed solely to match you with builders who service your ZIP code and to connect you with financial institutions that offer HELOC or construction loan pre-qualification options.

3. TCPA Consent Disclosure

IMPORTANT NOTICE UNDER THE TCPA: By checking the opt-in consent box on our lead capture form, you provide your express written consent to receive marketing and service-related communications, including phone calls, automated text messages (SMS/MMS), pre-recorded voice messages, and emails from ADU Profit and our matched general contractor or lending partners at the telephone number you provided. You understand that these communications may be transmitted using an automatic telephone dialing system (ATDS). Consent is not a condition of purchasing any property, materials, or services. You may opt out of receiving text messages at any time by replying "STOP".

4. Financing & RESPA Compliance

We provide access to home equity loan tools and financing partners for homeowner convenience. ADU Profit is not a mortgage broker, lender, or financial advisor. In strict compliance with Section 8 of the Real Estate Settlement Procedures Act (RESPA):

  • We do not charge, receive, or split referral fees, splits of loan origination fees, or transaction-based commissions from mortgage lenders or brokers.
  • Lenders and financial affiliates pay flat-rate, recurring monthly SaaS listing/advertising subscription fees to be listed on our platform, which represent fair market value for advertising placement.

5. State-Specific Privacy Rights

A. California Consumers (CCPA/CPRA)

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA), California residents have the following rights:

  • Right to Know: The right to request that we disclose what personal information we collect, use, and share about you.
  • Right to Delete: The right to request the deletion of your personal information collected by us.
  • Right to Correct: The right to request correction of inaccurate personal information.
  • Right to Opt-Out of Sale or Sharing: We do not sell your personal information in exchange for money. However, because sharing your contact details with contractors to match you with builders is considered a "sharing" of data for cross-context behavioral advertising or matching, you have the right to opt-out.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CPRA rights.

B. Texas, Florida, Colorado, and Washington Residents

As we expand coverage, residents of Texas (under the TDPSA), Colorado (CPA), Florida (FDBR), and Washington (MHMDA) are granted similar consumer data rights, including the right to request access, correction, deletion, and portability of their personal data, or to opt-out of targeted advertising and profiling. We respect these laws and honor valid deletion and opt-out requests from residents of all 50 states.

6. Data Security & Retention

We implement industry-standard physical, electronic, and administrative safeguards to secure the personal data we collect. Leads are retained in our secure database for up to 36 months to coordinate project updates and manage contractor disputes, unless a deletion request is received sooner.
